性侵的几个核心问题

JINGYAO案马上又要开庭了，正好看到这个剧，觉得里面有很多问题可以拿出来谈一谈。

（剧透！剧透！剧透！）

Hannah和Mitch这一条线是很多性侵案例中的核心问题：强权者进行性侵时，弱势一方没有明确拒绝，性侵发生后弱势一方获得了一些利益补偿。

Mitch认为这就是明明白白的一手交钱、一手交货，甚至在自己打算公开上采访时，认为Hannah能帮自己说话。

另一个点也踩得很准：我是全国数一数二的主持人，你是一个刚入职没多久的小职员，我带你回酒店看电影，会发生什么你心里没点数吗？

我之前和一个学法律的朋友谈过，对方对metoo的想法就是，疑罪从无是法律的基石，如果没有确切的证据，不能因此定罪。这一点我个人是赞同的，但与此同时应该注意到，metoo并非法律审判，而更多是道德上的谴责和社会层面的抗议。这一层面和性侵中强权者利用社会压力来进行性侵其实是合理的。

剧中有一段mitch和老友对话的内容也很深刻。Jagger比起Mitch来是大张旗鼓的性侵者（甚至恋童癖），他公开贬低女性，毫无同情心，而Mitch在和他对话的过程中渐渐将自己脱离出来：you're the predator, I'm not.

Ew

Mitch认为自己无罪的核心论点是，他和职员所有的性关系都是consensual（双方同意）的。但这一同意在hannah表现出的是什么呢？是职场新人面对大神的崇拜和敬仰，是对方赏识自己工作能力的感激。hannah在面对老师“回房间看电影“的邀约时，或许想到过这是不是个性信号，但努力工作、希望出人头地的她当然也不愿意因此凭空拒绝老师的好意，或许他只是想和我聊聊天呢？

我妈从小就告诉我，最好不要一个人去男老师的办公室，最好叫别的同学一起。但当你的导师真的有事找你的时候，你几乎不可能“哦我有个同学和我顺路一起来“，这太可疑了。

所以应该怎样呢？拒绝所有单独去男上级办公室的机会？于是“保护自己”的责任落在女性和弱势群体头上，同时意味着放弃掉正常工作的机会。而原本这些问题是可以被透明会议室、敞开的办公室门等等小措施从源头解决的。这些小措施为什么没有实行？因为权力的持有者在因此享受利益。

Metoo是为了什么？是为了大声表达that's not okay. 是为了向Fred等没有本人参与性侵、却纵容了这一行为的人敲响警钟。

Hannah的死是一个残酷的现实。如果她接受了LA的工作，那么她就永远无法摆脱他人认为她“一路睡上去”的恶言恶语；而如果她放弃目前拥有的一切，那么她也就放弃了自己所有的努力。她的解释和哭诉在性侵者面前只是“now you're playing the game"，似乎只有自己的死才能唤醒他们。

我很喜欢的另一个支线是Claire和Yanko。Claire一直是这段关系中比较push的一方，是她主动追求了Yanko，也能感觉她一直推动了这段关系的发展。Claire在一次对话中对yanko说，这段关系中我才是权力掌握者，我爸一个电话可以买下整个公司。

于是这个支线讨论的就是，如果一段职场恋情是权力相对平衡的，不存在明显的压迫和控制，这种关系是否可以被接受？

剧情的讨论是：可以接受，但你会经受许多压力。无论是来自HR还是周围的友人，真的关心你的人会为你担心，认为你看不清现实、或者迫于压力不敢开口，而怀揣恶意的人早已在背后讲过你一百个用色相往上爬的笑话了。

这可能就是从概率上而言，职场恋情从源头上就不被看好的原因。

这个剧前几集我甚至有点想弃，感觉只是著名女主播的烦心事，直到最后三集才渐入高潮，以小见大揭示出很多道理。

第一，没有人是永远的朋友。在Bradley决定采访Mitch时，Cory想说服Chip入伙，Chip作为Alex多年的搭档自然很犹豫，但也在逐渐认清局势后放弃了Alex。

而反过来，在Fred提议用Marton代替Chip时，Alex也是一开始犹豫，后来也果断放弃了Chip。

当然这其中还有很多起承转合的犹豫和彼此试探，但核心道理仍然是利益至上，而且这个利益是始终变动的，稍不注意就变成了权力斗争的下风。

（我反正是一边跪着看一边心想，这要是搁我我早就死在第一集了）

第二，你的筹码很可能变成对方要挟你的条件，这完全取决于什么时候、以及如何展现这个筹码。

我印象比较深刻的是NYTimes的记者Maggie。她先是Alex的朋友，后来开始采访Bradley，在Chip和她摊牌、希望曝光Fred之后又谨慎表达“这不足以扳倒他“，但等到Hannah的证据充足之后又正面和Fred坦白。整个一套下来，会让人感觉职场中是不存在所谓知恩图报的，一切都是利益，你需要做的不是成为一个好人，而是成为一个有利可图的人。

总之是个好剧，是我近年来看到的不拘泥于仅仅谴责性侵者、而是更深一步从性侵各个角度讨论权力平衡的平台。非常期待下一季。
